It is up to each individual EU Member State to designate the body or bodies who can issue European Arrest Warrants. However, the meaning and the scope of the concept of ‘issuing judicial authority’ for the purposes of issuing an EAW is an autonomous concept of EU law, which must be interpreted consistently across the EU.
